1. Agreement to Terms

By accessing or using the wydProxy secure tunneling service (the "Service") operated by Wyming Digital ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.

2. Acceptable Use Policy (AUP)

You agree to use the Service only for lawful purposes. You are strictly prohibited from using the Service to:

• Engage in any illegal activity, including but not limited to the distribution of malware, phishing, or unauthorized access to computer systems.
• Launch or facilitate Denial of Service (DDoS) attacks, port scanning, or network abuse.
• Transmit spam, unsolicited bulk messages, or malicious code.
• Infringe upon the intellectual property, privacy, or other rights of any third party.
• Attempt to bypass, reverse-engineer, or compromise the security of the wydProxy infrastructure or any connected Doer nodes.

Violation of this AUP will result in immediate termination of your account and tunnels without prior notice or refund. We reserve the right to monitor traffic patterns for abuse and cooperate fully with law enforcement agencies if illegal activity is suspected.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials, including your password and 2FA codes.
• You are solely responsible for all activities that occur under your account.
• You agree to provide accurate and up-to-date information during registration and billing.

4. Service Availability & Modifications

• The Service is provided on an "as is" and "as available" basis. While we strive for high availability, we do not guarantee 100% uninterrupted, error-free service unless explicitly stated in a separate Enterprise Service Level Agreement (SLA).
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
• We may update these Terms of Service periodically. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

5. Payments, Subscriptions & Refunds

• Billing: Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize us to charge your designated payment method.
• Refunds: We offer a 7-day money-back guarantee for new paid subscriptions. If you are unsatisfied, you may request a full refund within 7 days of your initial purchase. Refunds are not provided for accounts terminated due to AUP violations.
• Cancellations: You may cancel your subscription at any time via your Account Settings. Your Service will remain active until the end of your current billing period, after which your account will revert to the Free tier.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Wyming Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of or in connection with your use or inability to use the Service.

7. Indemnification

You agree to indemnify and hold harmless Wyming Digital, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any third-party rights.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
